Witness Agreement

This Witness Agreement (“Agreement”) outlines the terms under which individuals (“Witnesses”) accept and provide witness services through the Need A Witness UK platform (“the Platform”). By registering as a witness and accepting bookings through the Platform, you agree to the terms below.

1. Independent Basis

Witnesses use the Platform on a self-employed, independent basis. The Platform is structured so that witnesses may choose when to make themselves available and which bookings to accept.

• You choose which available jobs to accept
• You manage your own schedule and availability
• You are responsible for your own tax and National Insurance obligations
• You may provide services elsewhere and are not required to work exclusively through the Platform

Employment status under UK law depends on the reality of the working relationship and applicable legal tests. Nothing in this Agreement is intended to override rights or obligations that may apply by law.

2. Responsibilities of the Witness

You agree to:

• Arrive in good time for every booking you accept
• Dress appropriately and, where a customer has provided a reasonable dress-code preference, make reasonable efforts to follow it
• Act professionally, respectfully, discreetly, and courteously
• Follow lawful instructions given by the registrar, ceremony official, or venue staff
• Only sign documents where you understand what you are witnessing and are permitted to sign
• Notify Need A Witness UK immediately if you become unable to attend an accepted booking
• Keep customer and booking information confidential except where disclosure is necessary to fulfil the booking or required by law

3. Ceremony Requirements

You are responsible for ensuring that you are capable of acting as a witness for the ceremony you accept. Requirements can depend on the type of ceremony, registrar or ceremony official, venue, and applicable law.

You confirm that, when attending a booking, you will:

• be able to understand what you are witnessing
• be able to follow the instructions of the registrar or ceremony official
• be able to provide the information and signature reasonably required for the ceremony documentation
• tell Need A Witness UK promptly if you become aware of any reason you may not be able to act as a witness

4. Accepting & Declining Jobs

You may accept or decline any booking offered to you. Once you accept a booking, you are expected to attend and fulfil it professionally. If you can no longer attend, you must notify Need A Witness UK immediately so that a replacement can be sought.

5. Payments

Payment for an accepted and completed booking will be based on the amount or payout shown or agreed for that booking, subject to any applicable platform terms or deductions disclosed to you.

Payments are made using the payment details you provide. You are responsible for keeping those details accurate and for dealing with any tax, National Insurance, or other obligations relating to your income.

6. Travel

Unless a booking or payout arrangement states otherwise, you are responsible for making your own travel arrangements to and from accepted bookings. Any travel payment, mileage contribution, or reimbursement due to you will be confirmed as part of the booking or payout arrangement.

7. Cancellations & No-Shows

If you cannot attend a booking you have accepted, you must notify us as soon as possible. Repeated late cancellations, unexplained absences, or no-shows may result in suspension or removal from the Platform.

8. Conduct & Behaviour

You agree to:

• Behave respectfully toward customers, guests, registrars, ceremony officials, and venue staff
• Not attend a booking while impaired by alcohol or drugs
• Maintain confidentiality and professional boundaries
• Not use customer contact information for unrelated personal or commercial purposes

9. Data Protection

We process witness information for the operation of the Platform, including account administration, booking allocation, communications, payments, support, and safety. Relevant witness information may be shared with customers where reasonably necessary for a booking. Personal information must be handled in accordance with our Privacy Policy and applicable data-protection law.

10. Liability

You are responsible for your own conduct when providing an accepted witness service. Need A Witness UK is not responsible for independent acts or omissions that are outside its reasonable control. Nothing in this Agreement excludes or limits any liability or legal right where it cannot lawfully be excluded or limited.

11. Suspension or Removal From the Platform

We may suspend or remove access to the Platform where reasonably necessary, including for:

• Serious or repeated unprofessional behaviour
• No-shows, repeated lateness, or repeated late cancellations
• Misuse of customer or Platform information
• Providing materially false or misleading information
• Conduct that creates a reasonable safety, legal, or reputational concern

12. Acceptance

By registering as a witness and using the Platform, you confirm that you have read and understood this Agreement and agree to comply with the Witness Code of Conduct and other applicable Platform policies.
